STORMWATER MANAGEMENT AND EROSION CONTROL ORDINANCES
"Preventing pollution is the best solution"
On Tuesday, May 16, 2017, the City of Danville passed a revised stormwater management ordinance as well as a new erosion control ordinance. Both become effective May 27, 2017.
The Stormwater Management Ordinance, Chapter 162 of the City Code, amends the existing Chapter 162. The new stormwater ordinance is designed to "diminish threats to property, public health and safety, and welfare caused by increases in stormwater runoff from development...Increases in stormwater runoff quantity and rate, as well as the impairment of quality, are caused by development and land improvement and, as such, this ordinance regulates these activities to prevent adverse impacts caused by stormwater runoff created by such actions."
The amended Chapter 162 contains requirements for water quantity and water quality controls, though green infrastructure such as rain gardens, bioretentions, permeable pavements, etc. Water quality control and requirements are mandated by the ILR40 MS4 permit. They also make good sense for Danville to have functional stormwater management facilities that also help protect water quality and are aesthetically pleasing.

The Erosion Control Ordinance, Chapter 170 of the City Code, is a new ordinance for the City of Danville. The new ordinance is designed "to safeguard persons and protect property from the hazards and negative impacts of soil erosion created by land disturbing activities; to preserve and enhance water quality by preventing silt laden water from reaching creeks, channels, streams, wetlands, and other public waterways; to prevent storm water flooding caused by silt clogging storm water management infrastructure, such as storm sewers, inlets and receiving channels or streams; to promote public welfare by guiding, regulating and controlling the design, construction, use and maintenance of any development or other activity that disturbs soil on land situated within the city; to uphold the applicable requirements of the NPDES MS4 permit, and IL40 permit; to conserve, preserve and enhance the natural resources of the City including its soils, waters, vegetation, fish, and wildlife."
The new Chapter 170 will require any construction site or land disturbance of 2000 sf or larger to get an approved land disturbance permit prior to beginning construction. Class 1 (1.0 ac or more) and Class 2 (2000 sf - 1.0 ac) permits must meet the requirements set forth in the ordinance to ensure the design of the site accounts for reducing and containing sediment and soil loss within the site, and maintaining the necessary erosion control measures to prevent sediment and soil from escaping the site.
The new Chapter 170 will require any construction site or land disturbance of 2000 sf or larger to get an approved land disturbance permit prior to beginning construction.
